Equal Employment Opportunity
The Firm's labor and employment law practice includes the representation of clients in federal and state courts and agencies in all areas of EEO laws, including Title VII of the Civil Rights Act of 1964, as amended, the Americans with Disabilities Act, Executive Order 11246, the Rehabilitation Act of 1973, the Equal Pay Act and the Age Discrimination in Employment Act. We assist
clients in affirmative action issues and in responding to investigations by the EEOC, state civil rights commissions, the OFCCP and other agencies charged with enforcement of EEO laws. We also counsel clients concerning personnel decisions and policies affecting equal employment opportunity to assist them in avoiding legal action. The Firm has expertise representing
clients in EEO and civil rights litigation, including the defense of complex class actions and "pattern and practice" cases brought by private litigants and governmental agencies.
Wrongful Discharge Litigation
Our practice in this rapidly growing area of the law encompasses both advising
clients on policies, practices and procedures to minimize exposure to litigation and defending employers in state and federal courts in wrongful discharge lawsuits, involving both tort and contract claims.
N.L.R.B. Matters
The Firm's labor lawyers appear before the National Labor Relations Board
and the Public Employee Bargaining Act Boards in unfair labor practice and representation proceedings. We counsel
clients concerning legal and tactical considerations in union election campaigns.
Collective Bargaining, Arbitration, and Contract Administration
We represent clients in all phases of collective bargaining and labor contract administration, including review and formulation of contract proposals, preparation of contract language, advice regarding collective bargaining strategy, and contract negotiation. We are experienced in mediation by the Federal Mediation and Conciliation Service. We also have significant experience representing multi-employer groups and trade associations in collective bargaining negotiations.
The Firm's labor attorneys advise clients in the interpretation of collective bargaining agreements and represent clients in labor contract grievance disputes and "interest" arbitrations.
Health and Safety Law
We are experienced in health and safety law under both the Occupational Safety and Health Act
(OSHA) and state counterparts. The Firm's labor and employment lawyers assist
clients to prepare for inspections. We counsel our clients to minimize incidents which may give rise to litigation and we represent
clients in formal OSHA proceedings.
Wage and Hour Issues and Other Areas
Our expertise in this technical area includes litigation and counsel concerning federal and state laws governing minimum wages and overtime pay. Our attorneys are well versed on issues arising under the Fair Labor Standards Act, the Davis-Bacon Act, the Service Contracts Act, the Walsh-Healey Act, ERISA and other federal and state statutes, including the Migrant and Seasonal Agricultural Worker Protection Act, labor antitrust, unemployment compensation and workers' compensation laws.
